A PIP is the professional authorised to advise on, and facilitate formal debt solutions in Ireland. They can help you explore all available options and find a realistic, sustainable plan to ease the stress and worry caused by unaffordable debt.

What does a PIP do?

A PIP is qualified and authorised by the Insolvency Service of Ireland (ISI) to act on your behalf in matters relating to insolvency. Insolvency refers to a situation where you are unable to repay your debts, such as mortgage arrears, credit cards, or personal loans.

Your PIP will guide you through the insolvency process and help you find a tailored, legally recognised solution under Irish law. They negotiate with your creditors, aim to secure an agreement, and oversee the implementation and completion of the arrangement. Once completed, your debts will have been addressed and you’ll be given a fresh financial start.

The PIP process with McCambridge Duffy

Step 1: Free advice

When you first contact our advice team at McCambridge Duffy, you’ll receive a free, no-obligation assessment of your financial situation. We’ll review your debts, income, expenses, and assets to assess affordability and determine whether a debt solution is appropriate for your circumstances.

Based on this assessment, we will explain all suitable options, which may include:

Personal Insolvency Arrangement (PIA): A formal plan that restructures both secured and unsecured debts.

Debt Settlement Arrangement (DSA): A solution for unsecured debts only.

Debt Relief Notice (DRN): For individuals with low income and few assets.

Bankruptcy: Generally considered a last resort if other options are not viable.

You’re under no obligation to proceed, and there are no fees during this advice stage. We’re happy to answer your questions to ensure you fully understand the implications and requirements of each option.

We primarily offer PIAs and DSAs. If these are not suitable, we’ll explain any alternative solutions and refer you to an appropriate provider or charity for further help.

Step 2: Research and application

If you decide to move forward with a PIA or DSA, our research team will request all necessary documentation. One of our four experienced PIPs will then conduct a detailed analysis and begin preparing your Prescribed Financial Statement (PFS), which includes a comprehensive breakdown of your financial situation.

Once you’re satisfied with the PFS, your PIP will apply to the court for a Protective Certificate (PC). If granted, this provides legal protection from creditor action, such as repossession, for at least 70 days. This gives you breathing space while your PIP negotiates with your creditors.

Step 3: Securing your arrangement / Creditor negotiation

With the Protective Certificate in place, your PIP will lead negotiations with your creditors based on a formal proposal. This may include:

Suggested repayment of what you can reasonably afford

Proposed restructuring of secured debts (e.g., your mortgage)

Proposed write-off of unsecured debts

A structured repayment schedule

Creditors are invited to vote on the proposal. If the required majority approves, the court sanctions the arrangement, making it legally binding on all creditors.

If the proposal is rejected, you may be able to appeal. If the court deems it fair and reasonable, it can enforce the arrangement despite the initial rejection.

Step 4: Supervision and ongoing support

Once your PIA or DSA is approved, we will supervise it for its full duration. Our team will:

Monitor your progress

Manage and distribute payments to creditors

Handle any queries

Negotiate with creditors if your financial circumstances change

Provide support to help keep you on track

This oversight is vital to ensuring the success of the arrangement and maintaining trust between all parties involved.

How much do PIP services cost?

Our fees are deducted from your affordable monthly payments to creditors. We don’t charge upfront fees or separate costs for the initial consultation or application process. You only pay if an arrangement is successfully implemented and managed. All fees are clearly outlined in your proposal before you make any commitment.

We also participate in the Abhaile Scheme, a government-funded initiative that provides free financial and legal advice to people in mortgage arrears on their homes. This gives you access to expert advice and support at no cost to you, with the goal of helping you stay in your home wherever possible. If we believe you may qualify, we will help guide you through the application process.

Step 5: Completion: A fresh start

When your arrangement term ends and all conditions are met, your covered debts will be considered settled. You will be legally discharged from those debts and free to rebuild your credit and financial wellbeing.

If you’d like to learn more about how a PIP could help you manage unaffordable debt, avoid repossession, or deal with outstanding mortgage arrears, contact us today.
